Deep Dive: When a “Public Servant” is Just a Predator
The Headline: The Unnao Verdict: Why a Rapist MLA Isn’t a “Public Servant” (Technically).
The Question: Is justice blind, or is it just bad at reading definitions?
Yesterday, the Delhi High Court suspended the life sentence of Kuldeep Singh Sengar, the former BJP MLA convicted in the horrific 2017 Unnao rape case. The survivor, who has already lost her father to custodial torture and two aunts to a suspicious truck collision, called this decision “kaal” (death). And she is right to be terrified. But how does a man convicted of raping a minor while holding public office get his sentence suspended? The answer lies in a single, nauseating legal loophole: the definition of a “Public Servant.”
The “Aggravated” Loophole Sengar was originally convicted under Section 376(2) of the IPC and Section 5(c) of the POCSO Act. These sections deal with “aggravated” sexual assault—a category reserved for people in authority (like police, jail staff, or public servants) who abuse that power to commit rape. If you are a “public servant” and you rape someone, the law mandates a harsher punishment (often life imprisonment) because you have betrayed the public trust.
The trial court said Sengar, being an MLA, was obviously a public servant. The High Court, however, has paused that logic.
The Technicality That Freed Him The High Court’s reasoning hinges on statutory interpretation. It ruled that while an MLA is definitely a “public servant” under the Prevention of Corruption Act(so they can be tried for taking bribes), they are NOT a “public servant” under the Indian Penal Code (IPC) or POCSO Act.
Why? Because of a 1984 Supreme Court judgment (AR Antulay). That judgment held that MLAs are not “servants” of the government because they are not paid by the executive branch; they are independent legislators. Since Section 2 of the POCSO Act borrows its definitions from the IPC (and not the Corruption Act), the High Court concluded that Sengar cannot be punished as a “public servant” under POCSO.
The Disgusting Reality This is where the law divorces morality. We have a situation where an MLA can be called a “public servant” if he takes ₹500 under the table, but not if he rapes a child. The “aggravated” nature of his crime using his immense political influence to lure, rape, and then terrorise a family, is legally erased by a definition.
The Bottom Line By stripping away the “public servant” label, the court removed the “aggravated” charge for the purpose of this bail hearing, creating the grounds to suspend his sentence. The CBI is challenging this in the Supreme Court, but the damage is done. We have sent a message that political power doesn’t aggravate a crime; it provides a technicality to escape it. If a lawmaker isn’t a servant of the public, then who exactly are they serving?
